Terms of Service

These Terms of Service ("Terms") govern your use of callsforme.ai (the "Site") and the FSBO lead subscription services provided by RS Investment Properties Group LLC ("we," "us," or "our"). By using our Site or subscribing to our services, you agree to these Terms.

1. Service Description

We provide For-Sale-By-Owner (FSBO) lead lists to real estate agents and professionals through monthly subscription plans. Leads are compiled from publicly available sources and delivered based on the zip codes you select. We currently offer three subscription tiers: Starter ($49/month), Pro ($97/month), and Elite ($197/month).

2. Account Registration

To use our services, you must create an account with accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use our services.

3. Subscription and Billing

• Recurring Billing: Subscriptions are billed monthly on a recurring basis through Stripe. By subscribing, you authorize us to charge your payment method each billing cycle until you cancel.
• Price Changes: We may adjust pricing with at least 30 days notice. Existing subscribers will be notified by email before any price change takes effect.
• Failed Payments: If a payment fails, we may retry the charge and/or suspend your access until payment is resolved.

4. Cancellation

You may cancel your subscription at any time by contacting us at support@callsforme.ai or through your account dashboard. Upon cancellation:

• You will retain access to leads through the end of your current billing period.
• No further charges will be made after the current period ends.
• Cancellations are not retroactive. Partial month refunds are not provided for mid-cycle cancellations.

5. Refund Policy

We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with our service within the first 30 days of your initial subscription, contact us at support@callsforme.ai for a full refund.

After the initial 30-day period, refunds are provided at our sole discretion on a case-by-case basis. We do not guarantee refunds for any reason beyond the initial guarantee period.

6. Acceptable Use

You agree to use our services only for lawful purposes. You may not:

• Resell, redistribute, or share lead data with third parties or competing services
• Use automated tools to scrape, crawl, or extract data from our Site
• Use lead data for harassment, spam, or any purpose that violates applicable laws (including the Telephone Consumer Protection Act and CAN-SPAM Act)
• Attempt to circumvent zip code exclusivity limits or create multiple accounts
• Interfere with the operation or security of our Site

Violation of these terms may result in immediate account termination without refund.

7. Lead Data Accuracy

We make reasonable efforts to provide accurate, up-to-date FSBO lead information compiled from publicly available sources. However, we do not guarantee the accuracy, completeness, or timeliness of any lead data. Property details, contact information, and listing status may change without notice. It is your responsibility to verify lead information before taking action.

8. Zip Code Exclusivity

We limit the number of subscribers per zip code to a maximum of 3 agents. Zip code availability is subject to change and is allocated on a first-come, first-served basis. We reserve the right to modify exclusivity limits with advance notice to affected subscribers.

9. Intellectual Property

All content on our Site, including text, design, logos, and software, is owned by RS Investment Properties Group LLC or our licensors and is protected by copyright and intellectual property laws. Your subscription grants you a limited, non-transferable license to use lead data for your personal real estate business only.

10. Limitation of Liability

To the maximum extent permitted by law, RS Investment Properties Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. This includes, without limitation, lost profits, lost commissions, or business interruption.

Our total liability for any claim related to our services shall not exceed the amount you paid us in the 3 months preceding the claim. This limitation applies regardless of the legal theory (contract, tort, or otherwise).

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that leads will result in listings, sales, or any specific business outcome.

12. Indemnification

You agree to indemnify and hold harmless RS Investment Properties Group LLC, its officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorney fees) arising from your use of our services, violation of these Terms, or violation of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the courts located in Orange County, California.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will provide notice via email.
