VOICE CLONING CONSENT AND RELEASE AGREEMENT
This Voice Cloning Consent and Release Agreement (“Agreement”) is entered into by the individual identified below (“Consenting Party”) and CallsForMe LLC, a Wyoming limited liability company (“CallsForMe”). This Agreement governs CallsForMe’s creation and commercial use of a digital voice replica of the Consenting Party’s voice.
1. Grant of Authorization — California Civil Code — 3344; Cal. Lab. Code — 1703.5 (AB 2602)
Pursuant to California Civil Code § 3344 (right of publicity) and California Labor Code § 1703.5 (AB 2602, effective January 1, 2025), I, the Consenting Party, hereby grant CallsForMe LLC the irrevocable (subject to Section 6 below), royalty-free, non-exclusive right and license to:
- Record, capture, and process my voice from the audio sample(s) I provide;
- Use those voice samples to train and generate a synthetic AI voice model (“Voice Model”) that replicates my vocal characteristics;
- Deploy the Voice Model to conduct the following specific types of business phone calls on behalf of my business account with CallsForMe: (a) inbound call answering — greeting callers, answering inquiries, booking appointments, and qualifying leads; (b) outbound calling — appointment reminders, follow-up calls, lead qualification, and customer outreach; and (c) any other call type I expressly configure within my CallsForMe account dashboard; and
- Store the Voice Model securely for the term described in Section 4.
California AB 2602 Compliance Notice: This Agreement specifically describes how my digital voice replica will be used (as listed above), is signed and dated, and clearly states the scope, duration, and nature of the use, as required by Cal. Lab. Code § 1703.5. The Voice Model will not be used for any purpose not listed above without a new signed consent.
2. Scope of Commercial Use
I understand and acknowledge that the Voice Model will be used for commercial purposes — specifically, to conduct business telephone calls on behalf of my company using CallsForMe’s AI platform. I am authorizing this commercial use of my voice in writing, as required by Cal. Civ. Code § 3344. The Voice Model will be used only for the call types listed in Section 1 above. CallsForMe will not use my Voice Model to make political calls, emergency calls, charitable solicitation calls, or other call types not listed in Section 1, without obtaining a new written consent from me.
3. Voice Sample Ownership Representation
I represent and warrant that:
- The voice sample I will provide is my own voice; OR
- If the voice sample belongs to another individual (e.g., an employee or authorized representative), I hold a separate signed, written authorization from that individual that complies with Cal. Lab. Code § 1703.5 and all other applicable law, and I agree to provide that authorization to CallsForMe upon request.
I acknowledge that using someone else’s voice without that person’s proper written consent may violate California right of publicity law, AB 2602, and other federal and state laws, and that I assume full legal responsibility for any such unauthorized use.
4. Data Storage and Retention
- Raw voice recordings: Deleted within 30 days of successful Voice Model generation.
- Voice Model: Retained for the duration of my active CallsForMe subscription, plus 30 days after account closure, then permanently deleted.
- Upon revocation: As described in Section 6, the Voice Model will be permanently and irreversibly deleted within 7 business days of the revocation effective date.
- Consent records: This signed Agreement will be retained for the duration of the subscription plus 5 years for legal compliance purposes, even after Voice Model deletion.
All voice data is stored using AES-256 encryption at rest and transmitted using TLS 1.2 or higher.
5. Third-Party Restrictions
CallsForMe will not sell, license, sub-license, transfer, or share my Voice Model with any third party for any purpose. The Voice Model is used exclusively to power my own CallsForMe AI calling agent. My voice samples may be transmitted to ElevenLabs (CallsForMe’s voice synthesis provider) solely for the purpose of generating the Voice Model; CallsForMe’s agreement with ElevenLabs restricts ElevenLabs from using my voice samples for general AI model training.
6. Right of Revocation
I may revoke this consent at any time. To revoke:
- Send a written revocation request to: privacy@callsforme.ai with the subject line “Voice Consent Revocation — [Your Full Name / Business Name].”
- Revocation takes effect 60 days after CallsForMe receives my written request (the “Revocation Notice Period”), during which my Voice Model will continue to operate. I understand the Revocation Notice Period allows CallsForMe to transition my account to a non-cloned voice and is not intended to prevent or delay my right to revoke.
- If I require immediate cessation of Voice Model use (e.g., due to a dispute, unauthorized use concern, or legal requirement), I may request emergency suspension by calling (844) 643-9225 or emailing privacy@callsforme.ai with “URGENT” in the subject line. CallsForMe will suspend Voice Model use within 2 business days of confirming the request.
- Within 7 business days of the Revocation Effective Date, CallsForMe will permanently and irreversibly delete my Voice Model from all systems, including from ElevenLabs’ infrastructure.
- CallsForMe will send me written confirmation of deletion to the email address on file.
- Revocation of this consent does not cancel my CallsForMe subscription; my account will continue using a standard AI voice.
7. Duration and Scope
This consent is effective from the date of my electronic signature below and remains valid for the duration of my active CallsForMe subscription, unless I revoke it pursuant to Section 6. This consent covers the Voice Model created from the voice sample(s) I provide at the time of signing. If I submit new voice samples in the future, a new or updated consent may be required.
8. Biometric Data Compliance
I acknowledge that my voice characteristics may constitute biometric data or a biometric identifier under applicable state laws, including the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14/1 et seq.), the Washington My Health My Data Act, the Texas CUBI, and the California CPRA. By signing this Agreement, I provide the written release required by BIPA and the written consent required by other applicable biometric data laws. This Agreement, together with CallsForMe’s publicly available Biometric Data Retention and Destruction Policy (available upon request at privacy@callsforme.ai), constitutes CallsForMe’s compliance with applicable biometric data statutes.
9. Consent Is Not a Condition of Service
Providing voice cloning consent is not required to use CallsForMe’s services. CallsForMe provides default AI voices for all plans. Voice cloning is an optional feature. My decision to consent or not to consent will not affect the quality or availability of any service I am entitled to under my subscription plan.
10. Acknowledgment of Disclosures
I acknowledge and agree that:
- This Agreement will be recorded server-side with a timestamp and my IP address for legal compliance purposes.
- A confirmation copy of this signed Agreement will be sent to the email address I provide below.
- My IP address is logged at the time of signing as evidence of the geographic location and time of consent.
- This electronic signature constitutes a legally binding signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN, 15 U.S.C. § 7001) and the Uniform Electronic Transactions Act (UETA), to the extent applicable.
11. Governing Law
This Agreement is governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. California right of publicity law (Cal. Civ. Code § 3344) and California AB 2602 (Cal. Lab. Code § 1703.5) apply to the extent required by their terms.
